Rental Deductions on IRS: How Much Can You Deduct in 2026 and 2027?
Tenants can deduct 15% of the rent paid for their permanent home from their IRS tax due.
Under the Housing Package (Pacote Habitação), the general annual limit for this deduction increases to:
- €900 for the year 2026;
- €1,000 from 2027 onwards.
This increase can lower the amount of IRS owed, but it doesn’t mean every taxpayer automatically receives the maximum amount.
How Does the Rent Deduction Work?
The deduction corresponds to 15% of eligible rent paid during the year, up to the applicable legal limit.
For example, if a taxpayer pays €8,000 in rent during 2026, 15% of that amount comes to €1,200. However, the deduction will generally be capped at €900.
From 2027 onwards, the general limit rises to €1,000.
Is the Maximum Amount Always Applied?
No.
The deduction reduces the calculated IRS amount, but the actual benefit depends on each taxpayer’s individual situation, namely:
- the amount of rent paid;
- the tax assessed;
- the household’s income;
- other tax credits being claimed;
- the applicable general limits.
As a result, two tenants paying the same rent may not receive exactly the same tax benefit.
Which Rent Payments Can Be Deducted?
As a rule, the rent must relate to a property used as the taxpayer’s permanent home.
For the deduction to be properly considered, it’s important that:
- the lease agreement has been reported to the Tax Authority;
- the property is correctly identified;
- rent receipts are issued;
- payments are properly documented;
- the pre-filled figures on the IRS return are confirmed.
Where there are errors or missing amounts, taxpayers should check whether these can be corrected before filing their tax return.
Does Your Tax Address Matter?
Yes.
The Tax Authority can cross-reference the information in the lease agreement with the taxpayer’s registered tax address and the details declared on the IRS return.
When the rented property is the taxpayer’s permanent home, it’s important that this is accurately reflected in the tax records.
Can Foreign Citizens Also Benefit?
Yes, as long as they are tax residents in Portugal and meet the conditions set out in the IRS Code.
Nationality on its own is not relevant. What matters is tax residency, use of the property as a permanent home, and compliance with reporting obligations.
This is especially relevant in the Algarve, where many national and foreign residents alike rely on the rental market to establish their permanent residence.
Mistakes That Can Jeopardize the Deduction
The most common issues include:
- lease agreement not reported;
- missing or incorrect rent receipts;
- discrepancies between the lease and the declared amounts;
- outdated tax address;
- incorrect property identification;
- payments without proof.
Corrections may be possible afterward, but it’s better to verify the information before filing your IRS return.
