Controlled-Cost Housing: What Tax Benefits Exist?

2-3 minutes

Controlled-cost housing: what tax benefits exist?

The Housing Package created tax benefits for the first acquisition of controlled-cost housing intended exclusively for permanent, own-use residence.

The purchase may qualify for an IMT exemption or reduction, and a deduction on Stamp Duty. However, these benefits are not automatic and depend on the property, the buyer’s situation, and a decision by the municipality where the home is located.

What is controlled-cost housing?

The new tax regime does not create an independent definition of controlled-cost housing. The property’s qualification depends on the applicable legal regime and must be properly documented.

It is therefore not enough for a property to be marketed as controlled-cost housing. Before purchasing, it’s necessary to verify the property’s documentation and certification.

What IMT benefits exist?

On the first acquisition of controlled-cost housing for permanent, own-use residence, the following may apply:

  • IMT exemption when the taxable value does not exceed the maximum limit of the first bracket;
  • Progressive IMT rates for permanent housing when that value is exceeded.

In 2026, the maximum limit of the first bracket is €330,539.

A deduction on the Stamp Duty owed on the purchase may also apply, within the limits set by law.

Who can benefit?

The regime applies only to the first acquisition.

As a rule, the buyer must not be — nor have been, in the previous three years — the owner or holder of a share of ownership in another residential property.

Even holding a small share of another property can prevent the benefit from applying. The buyer’s asset situation should therefore be checked before signing the promissory contract.

Does the benefit depend on the municipality?

Yes.

The application of these benefits depends on a resolution by the municipal assembly, upon proposal from the relevant municipal council.

This means that a property’s qualification as controlled-cost housing does not, by itself, guarantee the exemption. It’s also necessary to confirm whether the municipality where the property is located has approved granting the benefits.

In the Algarve, this should be checked with the relevant municipality before purchasing.

What should be confirmed before the promissory contract?

Before committing to a purchase, it’s important to check:

  • whether the property is formally qualified as controlled-cost housing;
  • whether the buyer meets the personal conditions;
  • whether the municipality has approved the benefits;
  • the actual IMT and Stamp Duty amount owed;
  • whether the contract protects the buyer if the benefit is not recognized.

This analysis prevents the buyer from relying on an exemption that turns out to be inapplicable at the time of signing.

Frequently Asked Questions

Is all controlled-cost housing exempt from IMT?

No. The exemption depends on the property’s value, the buyer’s situation, and the municipality’s resolution.

Can I benefit if I’ve previously owned another home?

As a rule, no, if you held ownership of another residential property in the previous three years.

Does partial ownership of another property also count?

Yes. Holding a share or portion of ownership rights can rule out the benefit.

Does the benefit apply to a second home?

No. The property must be intended exclusively for permanent, own-use residence.
