Annual paid holiday entitlement
Each year, employees are entitled to 22 working days of paid holiday relating to the work carried out in the previous year. This right is acquired on 1 January. Exchanging holiday days for financial compensation is prohibited, even with the employee’s consent. At least 20 working days of holiday must be taken.
If the employee does not take some of the holiday days, the holiday allowance will be paid in full. In the event of illness during the holidays, they may be interrupted and resumed later, on a date agreed with the employer.
In the year of hiring, the employee is entitled to two working days of holiday for each month worked, up to a maximum of 20 days, which can only be taken after six months of work. If the year ends before then, the holidays must be taken by 30 June of the following year.
For contracts lasting up to six months, the employee is entitled to two working days of holiday for each full month worked, which must be taken before the contract ends, unless otherwise agreed between the parties.
When the contract ends, the employee is entitled to the holiday allowance and pay for accrued holidays not taken, as well as holiday days proportional to the work carried out in the year the contract ends.
The holiday period must be set out in a holiday map (mapa de férias) drawn up by the employer by 15 April and displayed in the workplace between that date and 31 October.
