Companies prohibited from outsourcing after dismissal
Companies are now limited to four renewals of temporary contracts and, if the contract ends for reasons not attributable to the employee, they may not outsource the same post or role until one third of the contract’s duration has elapsed. In addition, where the contract of a pregnant employee, an employee on parental leave or a carer is not renewed, the employer must inform the body responsible for equal opportunities between men and women at least five working days from the date of the notice.
Collective bargaining with additional benefits for companies
The State has decided to promote collective bargaining by integrating it into its specific policies. Companies that adopt collective bargaining will therefore be favoured in accessing public funding or support, such as European funds, public procurement and tax incentives. The aim of this measure is to encourage collective bargaining, allowing employers to set specific working conditions with workers’ representatives for the company or sector.
Limit of four renewals for temporary employment contracts
The Labour Code update reduces the maximum number of renewals allowed for temporary employment contracts from six to four. If a temporary contract exceeds this limit, it will be converted into a permanent employment contract for temporary assignment.
