Changes to the Portuguese Labour Code (Part II – SNS Sick Leave, Bereavement Leave and Pregnancy Loss Leave)

Changes to the Portuguese Labour Code (Part II – SNS Sick Leave, Bereavement Leave and Pregnancy Loss Leave) – labour code

Sick leave of up to three days via SNS24

The National Health Service line (SNS24) now makes it possible to request sick leave through a self-declaration, valid for three consecutive days, on a solemn declaration basis. This measure applies only to illnesses lasting up to three consecutive days and is limited to two uses per year. Although this absence is justified, it is unpaid. To submit the self-declaration, you must provide the access code received by SMS and/or email after it is issued.

Extended bereavement leave

The Labour Code has been revised to increase the leave period on the death of a spouse, child or stepchild from five to 20 consecutive days. On the death of other relatives or in-laws in the first degree of the direct line, leave has been extended to up to five consecutive days.

Introduction of pregnancy loss bereavement leave

A new leave has been introduced granting three consecutive days of bereavement leave to parents who suffer the loss of a child during pregnancy. This leave applies to both the mother and the father, without affecting rights or pay. To validate this leave, parents must present to the employer a statement issued by the hospital or health centre, or a medical certificate.
