Special rules for buildings under horizontal property
Condominium authorisation for Local Accommodation activity
Registrations of local accommodation establishments made after the Mais Habitação programme came into force now require the prior authorisation of the condominium for the different use of operating local accommodation, whenever the autonomous unit of a building under the horizontal property regime is intended for housing in the constitutive title.
This decision by the condominium is taken unanimously, and the minutes of the owners’ meeting containing this authorisation must be submitted with the prior notification to the Mayor of the competent Municipality.
Condominium opposition to Local Accommodation activity
The owners’ meeting may now oppose the operation of local accommodation in an autonomous unit or part of the building, provided that:
- the resolution is adopted by at least two thirds (⅔) of the building’s permillage (the value of each unit expressed in the horizontal property constitutive title);
- the horizontal property constitutive title does not expressly provide for the use of the unit for local accommodation purposes, or there has been an express (prior) resolution of that meeting authorising such use.
For the registration to be cancelled, the owners’ meeting must notify the Mayor of the competent Municipality of that resolution.
