Law no. 13/2026 has been published, authorising the Government to revise and extend the regime until 2026.
SIFIDE II is a tax incentive that allows a corporate income tax credit based on qualifying research and development (R&D) expenses.
Ignoring these changes is not an option.
What is at stake?
Key changes include: 🔹 Extension of the regime until 2026
🔹 End of the indirect access route through investment funds
🔹 Broader scope of eligible expenses, including innovation linked to R&D
🔹 Aggregated application under the tax group regime (RETGS)
🔹 Extension of execution deadlines to 5 years
🔹 Exclusion for entities benefiting from other public incentives
🔹 Increased transparency and reporting
The key issue
The end of fund-based access fundamentally changes the regime.
Assuming nothing changes is a mistake.
Some structures will no longer work.
Some strategies will need to be redesigned.
Some investments may lose efficiency.
Tax incentives require active management.
Practical impact
Companies relying on funds must reassess their structures.
Groups should revisit SIFIDE under RETGS.
R&D investment now requires more direct planning.
Important: these changes will only take effect after the implementing decree-law is approved.
If this impacts your structure, now is the time to act.
