Building or Refurbishing to Sell or Let? VAT May Drop to 6%

Portugal’s new Housing Package introduced one of the tax reforms most awaited by investors and property developers: the possibility of applying the reduced 6% VAT rate in mainland Portugal to specific construction or refurbishment works on residential buildings, which may be relevant for the Algarve region.

However, this reduction does not apply automatically. Access to the tax benefit depends strictly on the final use of the property, strict compliance with sale price or rent caps, tight procedural deadlines and correct contractual and tax structuring.

  • ⚖️ Practical note: it is essential not to confuse this new regime with the existing 6% VAT for works located in Urban Rehabilitation Areas (ARU) associated with an Urban Rehabilitation Operation (ORU). These are separate legal frameworks, with independent requirements and inspections by the Tax Authority (AT).

Which projects and investors can benefit from 6% VAT?

The reduced VAT rate aims to boost the moderate-cost housing market in the Algarve and the rest of the country. The regime applies to works on properties intended for:

  • Sale as the final buyer’s primary and permanent residence;
  • Exclusive long-term residential letting;
  • Structured projects under the new Rental Investment Contracts (CIA).

For 2026, the legal maximum reference limits set to safeguard the concept of moderate cost are:

  • Moderate final sale price up to €660,982;
  • Maximum moderate monthly rent up to €2,300.

These reference values may be updated by government order (portaria) in subsequent years.

Properties built or refurbished for sale: eligibility requirements

If the property developer in the Algarve carries out the project with a view to selling on the residential market, the advice of a specialist lawyer in Almancil becomes indispensable to ensure that:

  • The property is sold within a maximum of 24 months from the issue of the municipal use certificate or documentation.
  • The final buyer qualifies for the IMT treatment applicable to a primary and permanent residence.
  • The sale price strictly respects the moderate legal limit (maximum of €660,982 in 2026).
  • The title deed (public deed or authenticated private document) contains the express reference required by law to the application of the reduced VAT rate.

The residential use of the property must be fully reflected in all the transaction documentation, including the Promissory Purchase and Sale Contract (CPCV). If the buyer does not subsequently use the property as their permanent home, they may be subject to additional IMT of 10% of the property’s taxable value. The developer, however, remains fully responsible to the AT for complying with the conditions directly attributable to it, such as the price charged and the sale deadlines.

Properties built or refurbished for letting: long-term control

For owners and property companies building or refurbishing in the Algarve with a view to placing the properties on the rental market, the rules require ongoing monitoring:

  • The lease must be legally exempt from VAT and duly reported on the Tax Portal (Portal das Finanças).
  • The first tenant must start the lease within a maximum of 24 months after completion of the works and issue of the use licence.
  • The property must actually remain let for a minimum period of 36 months (consecutive or not) within the first five years of operation.
  • The rent may under no circumstances exceed the moderate cap (maximum of €2,300 in 2026).

Unlike projects intended for sale, where the benefit is consolidated when the deed is signed, in letting the conditions must be met over time. It is not enough to prove the initial intention; operational compliance must be maintained for years.

The planning timetable as a deciding factor

Timing is the first screening filter used by the Tax Authority’s audit algorithms. The regime only covers planning operations where the procedure (licence application or prior notification submitted to municipalities such as Loulé or Faro) is initiated between 25 September 2025 and 31 December 2029, with VAT becoming legally due between 1 January 2026 and 31 December 2032. The exact date of the first municipal application will determine whether or not the tax benefit can be accessed.

Main tax risks and loss of the benefit

The AT closely monitors these operations. The main triggers for the retroactive loss of the reduced VAT rate and the consequent application of fines are:

  • Failure to meet, or delays in meeting, the deadlines for sale or placing on the rental market.
  • Exceeding the maximum sale price or rent limits set for 2026.
  • A change in the residential use of the property (e.g. diversion to tourist or commercial use).
  • Absence of the mandatory legal references in works contracts or title deeds.
  • Failure to report leases to the AT in time.
