Labour Relations in the Public Sector

The aim of Labour Relations in the Public Sector is to ensure the balanced, lawful and efficient management of employment relationships between the State and its employees, safeguarding rights, duties and the proper functioning of public services.

Main Services:

1. Employment Regime and Career Management in the Public Administration

We provide support in the application of the General Labour Law for Public Service, the Labour Code and special regimes, with a particular focus on health and education. We handle matters such as progression, promotions, contractual arrangements, teleworking, performance appraisal (SIADAP), holding multiple posts, holidays, absences, leave and the status of student workers.

2. Procurement of Services and Engagement of Retirees

We provide legal advice on the legality of contracting services in the Public Administration and assess the possibility of engaging retirees and pensioners, in accordance with social protection and social security schemes.

3. Decent Work Agenda and Statute on Senior Staff (EPD)

We support the implementation of the measures under the Decent Work Agenda amongst public bodies and workers. We clarify the rights and duties of senior staff under the Statute on Senior Staff (Law No. 2/2004).

4. Collective Labour Law and Disciplinary Proceedings

We provide legal support in relations with trade unions, as well as in the negotiation and implementation of collective labour agreements. We also monitor all stages of disciplinary proceedings, ensuring compliance with the law and the rights of those involved.
